Preliminary Investigation to Determine Whether Block 76, Lot 18 (126–130 East Main Street) is an Area in Need of Redevelopment (Non-Condemnation Redevelopment Area)
Please Take Notice that, pursuant to the Local Redevelopment and Housing Law (the “LRHL”), N.J.S.A. 40A:12A-1 et seq., and specifically N.J.S.A. 40A:12A-6, the Planning Board of the Borough of Penns Grove (the “Planning Board”) will conduct a public hearing to determine whether the property described below constitutes an “area in need of redevelopment” within the meaning of the LRHL.
Please Take Further Notice that on June 3, 2026, the Mayor and Council of the Borough of Penns Grove (the “Borough Council”) adopted Resolution No. 2026-6-86, which authorized and directed the Planning Board to undertake a preliminary investigation of the below-described area and to conduct a public hearing thereon, and which further directed that the investigation be conducted to determine whether the area should be designated as a NON-CONDEMNATION REDEVELOPMENT AREA.
Date, Time, and Place of Hearing
The public hearing will be held on Wednesday, August 19, 2026, at 7:00 p.m., at the Borough of Penns Grove Municipal Building, [1 State Street, Penns Grove, New Jersey 08069], or at such other time and place to which the hearing may be adjourned or continued.

Area Under Investigation (The “Study Area”)
The area to be investigated consists of one (1) tax parcel identified on the Official Tax Map of the Borough of Penns Grove as BLOCK 76, LOT 18, commonly known as 126–130 East Main Street (the former Rite Aid site), together with all streets and rights-of-way appurtenant thereto. The Study Area comprises approximately 0.66 acres and is generally bounded by East Main Street and South Virginia Avenue (U.S. Route 130) at their intersection, by adjoining privately owned property to the west, and by adjoining privately owned property to the south. The Study Area is located in the H-C/I Highway-Commercial/Industrial Zone District.
Map and Statement of Basis Available for Inspection
A map showing the boundaries of the proposed redevelopment area and the location of the parcel included therein has been prepared, and a statement setting forth the basis for the investigation has been appended to that map. The map and appended statement, together with the preliminary investigation report prepared by the Board’s Professionals dated August 19, 2026, are on file and available for public inspection at the Office of the Municipal Clerk, Borough of Penns Grove Municipal Building, [1 State Street, Penns Grove, New Jersey 08069], during regular business hours, [Monday through Friday, 9:00 a.m. to 4:00 p.m.], and [shall be posted on the Borough’s website at www.pennsgrove-nj.com].
No Power of Eminent Domain
Please Take Further Notice that, in accordance with N.J.S.A. 40A:12A-6(b)(5)(b), A Redevelopment Area Determination Shall Not Authorize The Borough Of Penns Grove To Exercise The Power Of Eminent Domain To Acquire Any Property In The Delineated Area.
Opportunity To Be Heard
At the hearing, the Planning Board will hear all persons who are interested in, or who would be affected by, a determination that the Study Area is a redevelopment area. All objections to a determination that the Study Area is a redevelopment area, and evidence in support of those objections, will be received and considered and made part of the public record. Any person wishing to submit a written objection or written comment in advance of the hearing may do so by delivering the same to the Secretary of the Planning Board, Borough of Penns Grove Municipal Building, [1 State Street, Penns Grove, New Jersey 08069], or by electronic mail to the Municipal Clerk’s office, on or before August 17th. Any person submitting a written objection should state therein an address to which notice of the Planning Board’s determination may be sent.
Any interested person may appear at the hearing in person or through an attorney, and may present testimony, documents, exhibits, or other evidence. Persons who fail to raise an objection at the hearing, or who fail to commence a timely legal challenge to any determination made, may be precluded from raising such objections in any later proceeding.
Action To Be Taken
At the conclusion of the hearing, the Planning Board may adopt a resolution making its recommendation to the Borough Council as to whether the Study Area, or any portion thereof, should be designated as a Non-Condemnation Redevelopment Area under the LRHL. The Borough Council will thereafter consider the Planning Board’s recommendation and may, by resolution, designate the Study Area, or any portion thereof, as a Non-Condemnation Redevelopment Area.
The hearing may be adjourned or continued from time to time without further notice other than the announcement of the adjourned date, time, and place at the hearing.
This notice is given pursuant to N.J.S.A. 40A:12A-6(b)(3) and by direction of the Planning Board of the Borough of Penns Grove.
